These Terms of Service (the "Terms") apply to Labchaparro, an online store operated by Gomerchantsolutions Limited, a company registered in England and Wales under number 17322088. Please read them before you shop with us.

1. Scope of These Terms

The Terms govern your access to and use of this website and everything offered through it — its content, its features, its services, and every purchase you make (collectively, the "Platform").

Browsing the site or submitting an order tells us that you have read these Terms and our Privacy Policy, understood them, and agreed to be bound by them. Where you do not agree, we ask that you do not use the Platform.

2. Who May Order

Orders may only be placed by customers aged 18 or over. Using the Platform is your confirmation that you meet that age requirement.

Whenever you buy from us or write to us, the details you give us must be accurate, complete, and current. Where the Platform is misused, or where these Terms are broken, we may restrict or end your access.

3. Registered Accounts

Certain features of the Platform may ask you to create an account. Keeping your sign-in details private is your responsibility, as is everything done through your account.

An account belongs to one person and cannot be sold, transferred, or shared. Where unauthorised access follows from credentials that were not kept safe, Labchaparro carries no liability for it.

4. Placing an Order and Paying for It

Every order depends on stock being available and on our acceptance of it. At our discretion we may decline an order, cancel it, or limit its quantity — including where an order looks fraudulent, has been duplicated, or conflicts with these Terms.

Prices appear in the currency used at checkout and can be changed at any time, without notice being given beforehand. Completing a purchase authorises us to charge the payment method you selected for the whole order total, taxes and delivery charges included.

5. Products, Descriptions, and Stock

Items on the Platform may be sold online only and in limited numbers. Descriptions, prices, and availability may be revised at any time, and a product may be withdrawn altogether, without notice.

Product details are prepared with reasonable care. Even so, we cannot promise that the colours, textures, or finishes rendered by your screen will match the physical garment exactly.

6. Dispatch and Delivery

Independent carriers handle the dispatch of your order. Any delivery estimate we publish is indicative and is not a guarantee.

Labchaparro accepts no responsibility for delays caused by carrier performance, customs clearance, an address given incorrectly or incompletely, or anything else beyond our reasonable control.

7. Returning Items and Obtaining a Refund

A return is accepted within 30 days of the date your order was delivered. The item must come back unused, unworn, undamaged, and in the packaging it arrived in.

Write to contact@labchaparro.com to open a return. The cost of return postage falls to you, unless what you received was defective or was not the item you ordered.

Where a refund is approved, it is issued to the original payment method within 7 days of the returned item reaching us and being inspected.

8. Faulty or Damaged Deliveries

Contact us without delay if your order arrives faulty or damaged, describing the problem and attaching photographs that show it. We will look into it and, where appropriate, arrange a replacement, a refund, or another suitable outcome.

9. Services Supplied by Others

Third-party tools, services, or integrations may be reachable through the Platform. They are offered "as is", with no warranty of any kind attached.

We neither control nor take responsibility for those services, and we are not liable for anything that arises from your use of them.

10. Links to Other Websites

Links to sites run by other parties may appear on the Platform, and they are there purely as a convenience. External content, products, and services are not endorsed, monitored, or underwritten by us.

11. Material You Send Us

Reviews, feedback, ideas, and any other material you send us may be used by Labchaparro without restriction. In submitting content you grant us a perpetual, royalty-free, non-exclusive licence to use, reproduce, adapt, and distribute it.

We are not required to treat what you send as confidential, and no compensation is payable for it.

12. How the Platform May Not Be Used

You agree that you will not use the Platform to:

act contrary to any applicable law or regulation;
infringe intellectual property rights;
supply information that is false or misleading;
harass, abuse, or cause harm to another person;
distribute malware or other damaging code;
gather personal data without the consent of the individual concerned;
interfere with our security measures or the integrity of our systems.

Where this section is breached, access may be suspended or terminated immediately.

13. Errors and Corrections

Occasionally the Platform may carry an error or inaccuracy concerning a price, a promotion, a description, or availability. We reserve the right to correct any such error and to update the information at any time, without notice beforehand.

14. No Warranties

The Platform, along with every product and service made available through it, is supplied on an "as is" and "as available" footing.

Labchaparro extends no warranty of any kind, express or implied — this includes, without limitation, warranties of merchantability, of fitness for a particular purpose, and of non-infringement. Use of the Platform is at your own risk.

15. Limits on Our Liability

So far as applicable law allows, Labchaparro is not liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform or its products, or from your being unable to use them.

That limitation covers, without limitation, lost profits, lost data, and lost business opportunities.

16. Indemnity

You agree to indemnify Labchaparro and hold it harmless from claims, damages, losses, and expenses that arise out of your breach of these Terms or your misuse of the Platform.

17. Ending Access

Where these Terms have been breached, we may suspend or terminate your access to the Platform at any time and without notice.

Obligations that arose before termination remain in force afterwards.

18. Severability

Should any provision of these Terms be found unlawful or unenforceable, every remaining provision stays in full force and effect.

19. Applicable Law

The laws of England and Wales govern these Terms and guide their interpretation, without reference to conflict of law principles.

20. Changes to These Terms

These Terms may be revised at any time, and the version in force is always the one published on this page. Continuing to use the Platform means you accept whatever revisions have been made.
